Blockunity Business API - Operated by HYVI LDA

1. INTRODUCTION AND SCOPE

These API Terms of Service ("API Terms") govern your access to and use of the Blockunity Business API service ("API Service" or "Service") operated by HYVI LDA ("we", "us", "our", "Blockunity"). The API Service is accessible through the following domains:

  • business.blockunity.io - Primary Business dashboard and API portal
  • hyvicore.blockunity.io - API endpoint domain
  • hyvicore.com - Alternative API endpoint domain
  • hyvicore.io - Alternative API endpoint domain

By creating an account, generating an API key, or making any API request, you ("Client", "you") confirm that you have read, understood, and agree to be bound by these API Terms, our General Terms of Use, Privacy Policy, and API Privacy Addendum.

These API Terms supplement and do not replace our General Terms of Use. In case of conflict, these API Terms shall prevail with respect to the API Service.

We reserve the right to modify these API Terms at any time. The updated date at the top of this page indicates when the terms were last revised. Continued use of the API Service after modifications constitutes your acceptance of the updated terms.

2. SERVICE DESCRIPTION

The Blockunity Business API provides programmatic access to cryptocurrency and financial market data, analytics, indicators, scoring, and related computational tools via RESTful API endpoints. The Service is designed for integration into your applications, internal tools, or research workflows.

The API Service is an informational and analytical tool only. It does not provide investment, financial, or trading advice. It does not facilitate the purchase, sale, or exchange of any financial instruments. All data is provided on an "as-is" basis. You are solely responsible for any decisions made based on data obtained through the Service.

3. SUBSCRIPTION PLANS AND BILLING

3.1 Available Plans

The API Service offers three subscription tiers:

  • Starter - Designed for personal use, individual research, and evaluation purposes only. Not suitable for commercial or production use.
  • Professional - Designed for internal business use with higher rate limits and additional features.
  • Custom - A fully bespoke plan tailored to your specific needs, negotiated directly with our team.

3.2 Billing

  • Subscriptions are billed on a monthly or annual basis, with no long-term commitment. You may cancel at any time.
  • Payments are processed through Stripe. You must provide valid and current payment information.
  • If a payment fails, we may retry processing in the following days. Access to paid features will be suspended until payment is successfully processed.
  • Subscriptions renew automatically at the end of each billing cycle unless cancelled prior to the renewal date.

3.3 Free Trial Credits

Upon account creation, complimentary credits are provided free of charge to allow you to test and evaluate the API Service. These trial credits are subject to the same usage restrictions as paid credits. Trial credits may expire and cannot be transferred or exchanged for monetary value.

3.4 Credits and Overage

  • Each API request consumes a number of credits depending on the endpoint and complexity of the request.
  • Credits included in your plan are allocated per billing cycle and do not roll over to the next period (except purchased or bonus credits).
  • If overage billing is enabled on your plan, additional credits consumed beyond your allocation will be billed at the per-credit overage rate specified in your plan.

3.5 Refund Policy

Refund requests must be submitted within 14 days of subscribing by contacting [email protected]. Refunds are granted at the sole discretion of Blockunity and in compliance with applicable European consumer protection laws. Refunds may be denied in cases of significant API usage, abuse, or violation of these API Terms.

4. DATA LICENSE AND USAGE RESTRICTIONS

4.1 Limited License

Subject to your compliance with these API Terms and payment of applicable fees, we grant you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to access and use the data provided through the API Service solely within the scope permitted by your subscription plan.

4.2 Permitted Use by Plan

Plan Permitted Use
Starter Personal use only. Limited to individual research, learning, evaluation, and non-commercial personal projects. No internal business use, no production deployment, no redistribution.
Professional Internal use only. You may use the data within your organization for internal business purposes, including internal dashboards, research, analysis, and internal decision support tools. No external distribution, no commercial resale, no redistribution to third parties.
Custom As defined in the written agreement executed between you and HYVI LDA at the time of subscription. Commercial use is only authorized if explicitly stated in the Custom plan agreement.

4.3 Strictly Prohibited Uses

Regardless of your subscription plan, you shall NOT:

  • Resell, redistribute, sublicense, or commercially exploit any data obtained through the API Service, in whole or in part, in any form (raw, processed, aggregated, derived, or otherwise), unless explicitly authorized in writing under a Custom plan agreement.
  • Make data available to third parties through any means, including but not limited to: public APIs, data feeds, downloadable datasets, embedded widgets displayed to third-party end users, or any form of data brokerage.
  • Use data to build or enhance competing products or services that replicate or substitute the functionality of Blockunity's offerings.
  • Systematically scrape, bulk-download, or cache API responses for the purpose of creating a local mirror or replica of our dataset, beyond what is reasonably necessary for your permitted use and reasonable operational caching.
  • Present data as your own or remove, obscure, or alter any attribution, watermark, or proprietary notice associated with Blockunity data.
  • Use data for any illegal, fraudulent, or malicious purpose, including but not limited to: market manipulation, insider trading facilitation, money laundering, or any activity that violates applicable laws or regulations.
  • Use data to train, fine-tune, or develop machine learning or AI models intended for commercial distribution or sale, unless explicitly authorized under a Custom plan agreement.
  • Share API keys or access credentials with any unauthorized person or entity, or allow access to your account by unauthorized parties.

4.4 Audit Rights

We reserve the right to audit your use of the API Service to verify compliance with these API Terms. We may request information about your usage patterns, integration architecture, and data handling practices. Non-compliance may result in immediate suspension or termination of your access.

5. API KEY AND ACCOUNT SECURITY

  • You are responsible for maintaining the confidentiality and security of your API keys and account credentials at all times.
  • API keys must not be embedded in client-side code, public repositories, or any publicly accessible location.
  • You must immediately notify us at [email protected] if you suspect unauthorized use of your API key or account.
  • We recommend using IP whitelisting and key rotation features to enhance security.
  • You are fully responsible for all activity that occurs under your API keys and account, whether or not authorized by you. We are not liable for any loss or damage arising from your failure to secure your credentials.

6. ACCEPTABLE USE AND INFRASTRUCTURE PROTECTION

6.1 Rate Limits

Each subscription plan has defined rate limits (requests per second and per minute). You must respect these limits. Exceeding rate limits will result in HTTP 429 (Too Many Requests) responses. Persistent or deliberate rate limit violations may result in temporary suspension or permanent termination of your access.

6.2 Prohibited Technical Activities

You shall NOT:

  • Attempt to circumvent rate limits, authentication mechanisms, credit tracking, or any other security or access control features.
  • Send requests designed to overload, stress-test, or disrupt the API infrastructure, or perform any form of denial-of-service attack.
  • Probe, scan, or test the vulnerability of the API Service or any related system without prior written authorization.
  • Use automated tools, bots, or scripts in a manner that creates an unreasonable or disproportionate load on our infrastructure.
  • Attempt to access endpoints, data, or features that are not included in your subscription plan or not authorized for your account.
  • Reverse engineer, decompile, disassemble, or otherwise attempt to derive the source code, algorithms, or data structures underlying the API Service.
  • Interfere with or disrupt the integrity, performance, or availability of the API Service for other users.
  • Forge headers, manipulate identifiers, or otherwise disguise the origin of API requests.

6.3 Degraded Mode

We reserve the right to place your account in degraded mode (reduced rate limits) at any time if we detect abnormal usage patterns, suspected abuse, or infrastructure strain caused by your activity. Degraded mode may be applied without prior notice.

6.4 Monitoring

We actively monitor all API usage for security, billing, and compliance purposes. This includes logging request metadata (endpoints accessed, timestamps, IP addresses, response codes, credit consumption) as described in our API Privacy Addendum.

7. SERVICE LEVELS (INDICATIVE)

The following service level targets are provided for informational purposes only and do not constitute a binding commitment, guarantee, or contractual obligation of any kind.

7.1 Uptime Target

We aim to maintain a high level of API availability. However, we make no guarantee of any specific uptime percentage. The API Service may be unavailable from time to time due to scheduled maintenance, unscheduled maintenance, infrastructure issues, third-party service failures, or force majeure events.

7.2 Response Time

We strive to provide responsive API endpoints. However, response times may vary depending on the endpoint complexity, data volume, server load, network conditions, and other factors. No specific response time is guaranteed.

7.3 Support Response Time

We aim to respond to support requests within a reasonable timeframe depending on your plan tier. Support response times are provided as indicative targets only and do not constitute a binding commitment. We shall not be liable for any delays in support response.

7.4 No SLA Credits or Compensation

Unless explicitly agreed in a Custom plan agreement, no service-level credits, refunds, or compensation of any kind shall be owed for downtime, degraded performance, or support delays.

8. DISCLAIMERS AND LIMITATION OF LIABILITY

8.1 Data Accuracy

The data provided through the API Service is aggregated from various third-party sources and proprietary calculations. We do not guarantee the accuracy, completeness, timeliness, or reliability of any data. Data may contain errors, inaccuracies, omissions, or delays. We may modify, update, or discontinue any data point or endpoint at any time without prior notice.

8.2 No Investment Advice

The API Service and all data provided through it are for informational and analytical purposes only. Nothing provided through the API Service constitutes investment advice, financial advice, trading advice, or any other form of professional advice. You are solely responsible for your investment decisions and actions.

8.3 "As-Is" Provision

THE API SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, NON-INFRINGEMENT, OR UNINTERRUPTED AVAILABILITY.

8.4 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, HYVI LDA, ITS DIRECTORS, OFFICERS, EMPLOYEES, AGENTS, AND AFFILIATES SHALL NOT BE LIABLE FOR:

  • Any direct, indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the API Service.
  • Any loss of profits, revenue, data, business opportunities, goodwill, or anticipated savings.
  • Any damages arising from inaccurate, erroneous, incomplete, or delayed data provided through the API Service.
  • Any damages arising from unauthorized access to or alteration of your data, transmissions, or API keys.
  • Any damages arising from the conduct of third parties, including third-party data providers.
  • Any damages arising from scheduled or unscheduled maintenance, service interruptions, infrastructure failures, or degraded performance.
  • Any damages arising from changes to the API, endpoints, data structures, or discontinuation of any feature.
  • Any damages arising from cyberattacks, security breaches, bugs, viruses, or other harmful components.
  • Any damages arising from your reliance on any data, content, or information obtained through the API Service.
  • Any failure or delay due to force majeure events, including but not limited to: natural disasters, acts of war or terrorism, cyberattacks, government actions, power failures, network failures, or third-party service outages.

IN ANY EVENT, OUR TOTAL AGGREGATE LIABILITY ARISING OUT OF OR RELATED TO THESE API TERMS OR THE API SERVICE SHALL NOT EXCEED THE TOTAL AMOUNT OF FEES PAID BY YOU TO US IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM.

9. INTELLECTUAL PROPERTY

All intellectual property rights in and to the API Service, including but not limited to the API design, documentation, data structures, algorithms, proprietary indicators, scoring methodologies, computed metrics, and all associated content, are and remain the exclusive property of HYVI LDA.

Your subscription grants you a limited license to use the API Service as described in Section 4. No ownership of or intellectual property rights in any data, software, or content are transferred to you.

The Blockunity and HyviCore brands, logos, and trademarks are the property of HYVI LDA and are registered with the INPI. Any unauthorized use is strictly prohibited.

10. TERM, SUSPENSION, AND TERMINATION

10.1 Term

These API Terms are effective from the date you first access or use the API Service and remain in effect until terminated.

10.2 Your Right to Cancel

You may cancel your subscription at any time. Access will continue until the end of the current billing period. No partial refunds are provided for the remainder of a billing period.

10.3 Our Right to Suspend or Terminate

We reserve the right to immediately suspend or terminate your access to the API Service, without prior notice and without liability, for any of the following reasons:

  • Violation of any provision of these API Terms.
  • Unauthorized or abusive use of the API Service or data.
  • Non-payment or payment failure.
  • Activity that threatens the security, integrity, or availability of our infrastructure.
  • Use of the API Service for illegal, fraudulent, or malicious purposes.
  • Suspected data resale or unauthorized redistribution.
  • Providing false or misleading information during registration.
  • Any other reason we deem necessary to protect our interests, infrastructure, or other users.

10.4 Effects of Termination

  • All API keys associated with your account will be immediately revoked.
  • Unused credits are forfeited and not refundable.
  • You must immediately cease all use of data obtained through the API Service and destroy any cached or stored copies, except as required by applicable law.
  • Sections of these API Terms that by their nature should survive termination shall survive, including but not limited to: Data License Restrictions (Section 4), Disclaimers (Section 8), Intellectual Property (Section 9), Indemnification (Section 11), and Governing Law (Section 13).

11. INDEMNIFICATION

You agree to indemnify, defend, and hold harmless HYVI LDA and its directors, officers, employees, and agents from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising from or related to:

  • Your use or misuse of the API Service.
  • Your violation of these API Terms.
  • Your violation of any applicable law or regulation.
  • Any unauthorized use, redistribution, or resale of data obtained through the Service.
  • Any claim by a third party arising from your use of the data.
  • Your failure to secure your API keys or account credentials.

12. THIRD-PARTY DATA AND SERVICES

The API Service may include data sourced from third-party providers. We do not control and are not responsible for the accuracy, reliability, completeness, or timeliness of third-party data. Third-party data is provided subject to the respective provider's terms and conditions.

Payments are processed by Stripe. Your use of Stripe's payment service is subject to Stripe's Terms of Service.

13. GOVERNING LAW AND DISPUTE RESOLUTION

These API Terms shall be governed by and construed in accordance with the laws of Portugal, without regard to its conflict of law provisions. Any dispute arising out of or in connection with these API Terms or the API Service shall be submitted to the exclusive jurisdiction of the Portuguese courts.

Before initiating legal proceedings, both parties agree to attempt to resolve any dispute through good faith negotiations for a period of at least thirty (30) days.

14. GENERAL PROVISIONS

  • Severability: If any provision of these API Terms is found to be unenforceable or invalid, the remaining provisions shall continue in full force and effect.
  • Entire Agreement: These API Terms, together with the General Terms of Use, Privacy Policy, API Privacy Addendum, and any Custom plan agreement, constitute the entire agreement between you and HYVI LDA with respect to the API Service.
  • No Waiver: Our failure to enforce any right or provision of these API Terms shall not constitute a waiver of that right or provision.
  • Assignment: You may not assign or transfer your rights under these API Terms without our prior written consent. We may assign our rights and obligations without restriction.
  • Notices: We may send notices to the email address associated with your account. It is your responsibility to keep your contact information up to date.

Theme

Mode
Allows you to switch between the Lite and Advanced modes of the application. Lite mode simplifies the display of certain functions, especially for beginners. Advanced mode, by default, lets you use the full capabilities of the platform.
Animations
Allows you to choose whether or not to display certain application animations, in particular to disable animated backgrounds for better readability if necessary.
