AGREEMENT TO THESE TERMS

Welcome to Blockunity. These Terms of Use (or "Terms") are an agreement between you and Blockunity (or "we", "us", "our"), property of HYVI LDA, concerning your use of our services.

By accepting these terms, you agree that you have read and understood our Terms, and you will be able to use our platform, as long as you follow these Terms.

To use our services, you must be of the age of majority in your country of residence.

These Terms can evolve at any time. For all changes, the date will change at the top of this page and you can freely consult this page at any time to see the changes. Your continued use of our services after these changes constitutes your acceptance of the new Terms of Use.

You must agree to these terms before using the platform. Continued use of the platform constitutes acceptance of any updates.

OUR SERVICES

Blockunity is your gateway to simplified yet comprehensive cryptocurrency insights. We aggregate and simplify expert data, providing you a one-stop solution for all your crypto investment needs. Designed for the novice but built with pro-level insights.

Nevertheless, you cannot sell, swap or purchase cryptocurrencies on Blockunity. Therefore, Blockunity does not provide investment, financial or trading advice. You are solely responsible for your actions and investment decisions.

USER OBLIGATIONS

You confirm that:

You will provide true, complete, accurate and current information when registering and will keep it up to date. You are responsible for your own content.
You will respect copyright, trademark and other intellectual property rights when using online content.
You will respect other users, including by not posting offensive content, not harassing other users, and not violating their privacy.
You are not a minor in your country of residence, or have received parental permission to use our services.
You will take reasonable steps to protect your data, including using strong passwords and other means to ensure optimum security.
You will not use our Site for illegal or unauthorized purposes.
You will not access Blockunity through automated or non-human means.
You will not publish Blockunity data, metrics, graphs, or other content outside of the platform without written permission from an official HYVI LDA executive member.
You will use authorized payment methods only.
You will not share your access to Blockunity with anyone else.

Any violation of these obligations will result in immediate termination of your access to our services.

PROHIBITED ACTIVITIES

By using Blockunity, you agree not to engage in the following:

Abusive activity: Importing malicious material (viruses, spams, malware); using or distributing automated tools such as data mining bots, extraction tools, robots, or scripts; transferring or selling your account to a third party; providing false or misleading information; retrieving content without authorization; advertising on the Site; competing with us for any revenue-generating endeavor; creating an undue burden on the Site; interfering with security features; or distributing illegal content including content inciting hatred, terrorism, defamation, or exploitation.
Abuse of other users: Harassing, threatening, defaming, extorting, intimidating or abusing other users or employees of Blockunity; collecting or using their information against them; conducting malicious activities such as denial of service attacks or hacking attempts; or violating the privacy of others.
Intellectual property violations: Engaging in any transaction that violates privacy, copyright or proprietary rights; deleting copyright or proprietary rights notices; copying, transferring, selling, renting, distributing, compiling/decompiling or modifying our services or code; or distributing content that infringes trademarks, patents or copyrights.

TERM AND TERMINATION

These Terms of Use will continue to govern your use of our services until either party decides to terminate them. You may terminate this agreement at any time by canceling your access to our services. We may terminate or suspend your access if you breach these Terms of Use.

In the event of a dispute, we will first attempt to resolve it through good faith negotiations. If we cannot resolve the dispute through negotiations, it will be submitted to the exclusive jurisdiction of the Portuguese courts and governed by Portuguese law.

Upon termination, certain provisions will continue to apply, including your obligation to pay any outstanding fees. We may delete content or data associated with your account and block your access to our services.

Creating a new account with a fake name, or a third-party name, is strictly prohibited and can lead to legal action.

THIRD-PARTY SERVICES

Blockunity may integrate or link to services, tools and content provided by third parties ("Third-Party Services"). These third parties may include business partners, data providers, payment processors, advertisers and other external websites or platforms.

We are not responsible for any Third-Party content, the accuracy or legality of their services, or any risks, damages or losses arising from your use of such services. If you access a Third-Party Service, you do so at your own risk and should review their Terms of Use and Privacy Policy before proceeding.

We are not liable for the inaccuracy of data or the reliability of services provided by third parties. Any disputes arising from the use of Third-Party Services are between you and the relevant third party.

AVAILABILITY AND ACCURACY

Our objective is to provide you the best services. However, our platform may experience interruptions due to internal or technical issues, or in the event of force majeure. Force majeure events include, but are not limited to: natural disasters, acts of war or terrorism, network or server failures, power outages, cyberattacks, or decisions by government authorities.

We aim to provide information that is as accurate as possible, although our platform may contain inaccuracies due to technical issues or necessary adjustments. Information may be updated from time to time without notice. All decisions you make after consulting this information are your sole responsibility.

SUBSCRIPTION PLANS

Blockunity offers various subscription plans, each providing different levels of access and features. Details of each plan, including pricing and available features, can be found on our website: https://app.blockunity.io/subscription/pricing.

Billing and Payment

Billing Cycle: Subscriptions are billed on a recurring basis as per the selected plan (e.g., monthly, annually).
Payment Methods: We accept various payment methods, including credit/debit cards and other authorized methods.
Payment Information: You must provide current, complete, and accurate payment information. You authorize us to charge your payment method for subscription fees and any other charges you may incur.
Payment Issues: If a payment is declined, we will automatically retry processing in the following days. Access to paid features will be suspended until the payment is successfully processed.

Free Trials

Eligibility: We offer a 7-day free trial for all subscription plans, available only once per user.
Transition to Paid Subscription: If you do not cancel your subscription before the end of the free trial period, you will automatically be charged for the selected subscription plan.

Plan Changes

Upgrade: If you upgrade your plan, your current subscription will be cancelled and you will be subscribed to the new plan immediately. You will only pay the prorated difference.
Downgrade: If you downgrade your plan, your current subscription will be cancelled and you will be subscribed to the new plan immediately. Your next payment date will be extended by a number of days proportional to the difference in plan costs.

Renewal and Cancellation

Automatic Renewal: Your subscription will automatically renew at the end of each billing cycle unless you cancel it prior to the renewal date.
Cancellation: You can choose to cancel your subscription at the end of the current billing cycle. Access to the services will continue until the end of the paid period.

Refund Policy

Refund Requests: Refunds can only be requested by contacting us at [email protected].
Eligibility: Refund requests must be made within the first 14 days of subscribing, and you must have used the service for at least 3 days.
Scope of Withdrawal Right: Any statutory 14-day withdrawal and reimbursement right applies to the initial subscription contract only. To the extent permitted by applicable law, this right does not apply to automatic renewals of the subscription.
Discretion: Refunds are granted at the discretion of Blockunity and in compliance with applicable European laws, including the EU Consumer Rights Directive (2011/83/EU).
Denial of Refunds: Reasons for denying refunds include but are not limited to: excessive usage, abuse of the refund policy, requests outside the eligible time frame, fraudulent activities, continued use of the service after the refund request, failure to comply with verification requirements, or violation of these Terms.

You can update your payment method at any time from your user profile.

By subscribing to Blockunity, you acknowledge that you have read, understood, and agreed to these subscription terms.

DISCLAIMER

By using Blockunity, you agree that you are aware of the following risks.

Risk Warning: Investing in digital currencies, stocks, securities, commodities and other derivative investment products (contracts for difference: "CFDs") is speculative and extremely risky. Each investment is unique and involves specific risks. Cryptocurrencies and blockchains are emerging technologies with unpredictable risks and can be subject to hacking attempts. CFDs and other derivatives are complex instruments; rapid loss of money is possible due to leverage. You must be sure you understand how investing works and whether you can afford to take the risk of losing your money. The invested capital is not guaranteed. Cryptocurrencies can fluctuate greatly and are therefore not suitable for all investors. Trading in crypto-assets is not overseen by an EU regulatory framework.

You are responsible for your actions. Blockunity excludes all liability for any damage caused directly or indirectly as a result of the use of the Site. In particular, Blockunity will not be responsible for any damage caused by:

Any infringement of intellectual property rights by third parties.
Any unauthorized access to or alteration of transmissions or data.
The inability to use the Site.
Irregular use of the Site by a third party, including unauthorized access to https://blockunity.io/.
The inaccuracy of information on the Site. It is always your responsibility to verify information through different sources.
Failure of third-party exchanges. Blockunity does not take part in any transaction carried out by you. We only provide tools to create and execute operations on cryptocurrencies through third-party APIs.
Loss or damage arising from any event of failure.
Cyberattacks, malfunctions, hacks, or any errors, bugs, viruses, or other harmful components transmitted through the platform.
Loss arising from Blockunity strategies.
Illegal use of our services.
Technical issues related to blockchain technologies.
Any direct, indirect, incidental, special, or consequential damages arising out of or connected with the use of the platform, even if we have been advised of the possibility of such damages.
Any inaccuracies or omissions in any content on the platform.
Force majeure events, including but not limited to acts of God, war, terrorism, civil unrest, strikes, power failures, or equipment malfunctions.

INTELLECTUAL PROPERTY

This Site and its content are protected by copyright, European intellectual property law (Directive 2004/48/EC) and the Portuguese Intellectual Property Code (Codigo da Propriedade Intelectual).

The content of the Site, including but not limited to images, graphics, texts, videos, logos, and icons, are the exclusive property of HYVI LDA, with the exception of brands, logos or content belonging to other partner companies or authors.

Under the European Union Trade Mark Regulation (EU) No 2017/1001, any total or partial reproduction, representation, transfer, distribution, or recording of all or part of these elements is strictly prohibited without the express authorization of HYVI LDA.

The Blockunity brand and its associated logos are registered with the INPI, protected and property of HYVI LDA. Any total or partial reproduction is strictly prohibited.

All strategies built by users on Blockunity are our property. They may be used, exploited and transferred at no charge, for advertising and commercial purposes.

GOVERNING LAW

These Terms of Use shall be governed by and construed in accordance with the laws of Portugal. Any dispute arising out of or in connection with these Terms shall be submitted to the exclusive jurisdiction of the Portuguese courts.

If any provision of these Terms is found to be unenforceable or invalid, the remaining provisions will continue to be in full force and effect.

BLOCKUNITY BUSINESS API

If you use the Blockunity Business API service (accessible through business.blockunity.io, hyvicore.blockunity.io, hyvicore.com, or hyvicore.io), your use is also governed by the API Terms of Service and the API Privacy Addendum, which contain additional terms specific to the API service.
