AGREEMENT TO THESE TERMS

Welcome to Blockunity. These Terms of Use (or “Terms”) are an agreement between you and Blockunity (or “we”, “us”, “our”), property of HYVI LDA concerning your utilisation of our services.

By accepting these terms, you agree that you have read and understood our Terms, and you will be able to use our platform, as long as you follow these Terms.

To use our services, you must be of the age of majority in your country of residence.

These Terms can evolve at any time. For all changes, the date will change at the top of this page and you can freely consult this page at any time to see the changes. Your utilisation of our services after these changes constitute your acceptance of the new Terms of Use.

OUR SERVICES

Blockunity is a cutting-edge platform dedicated to crypto market analysis, trading, and portfolio tracking, which handles all the necessary data flow for any type of crypto trader and investor profile. It offers an intermediary service where you can connect all your wallets and exchanges to our platform. We provide a screener to visualize the cryptocurrencies, a strategy builder with backtesting, and a portfolio overview with manual management. Blockunity can at any time and for no reason modify or delete some features of the strategy builder. Moreover, you agree that you are solely responsible for your actions, including with no limitation setting and execution of the strategies.

Nevertheless, you can’t sell, swap and purchase cryptocurrencies on Blockunity. Therefore, Blockunity does not provide investment, financial or trading advice. You are responsible for your actions.

USER OBLIGATIONS

You confirm that:

  • Protection of personal data: You must comply with regulations on the protection of personal data, in particular by providing accurate and up-to-date information when registering for an online service, by giving their consent to the processing of their data, and by respecting the rights of the persons concerned. All information that you provide to us will be true, complete, accurate and current. You are responsible for your own content.
  • Respect for intellectual property rights: You must respect copyright, trademark and other intellectual property rights when using online content.
  • Respect for other users: You must respect other users when using online services, including not posting offensive content, not harassing other users, and not violating their privacy.
  • You are not a minor in your country of residence, or have received parental permission to use our services.
  • Data security: You should take reasonable steps to protect their data, including using strong passwords and other means to ensure optimum security.
  • You will not use our Site for illegal/unauthorized purposes.
  • You will not access Blockunity with non-human means.
  • Avoiding illegal activities: You should not use the online services for illegal purposes, such as selling counterfeit goods, online harassment or sharing offensive or illegal content.
  • Do not publish Blockunity data, metrics, graphs, and other content outside of the platform without written permission from an official HYVI LDA executive member.
  • You will use authorized payment methods.
  • Do not share your access to Blockunity with anyone else.

Any violation of these “User Obligations” will result in immediate termination of your access and rights for our services.

PROHIBITED ACTIVITIES

By using Blockunity, you agree to not do the following activities:

  • Abusive activity: To import any material that acts as information collection or transmission including without limitation: virus, spams, gifs or cookies. Using, developing or distributing automated tools including without limitation : data mining, extraction tools, robots, scripts. To transfer or sell your account and data to a third party. To provide false, misleading or incomplete information to Blockunity. To do unlawful activity on our Site. To retrieve content from Blockunity without having written to us. To make advertising on the Site. To compete with us for any revenue-generating endeavor or commercial enterprise. To create an undue burden on the Site. To interfere and attempt to modify the security-related features of Blockunity. To harm or tarnish Blockunity. You are not allowed to distribute content that is illegal, such as content that incites hatred, terrorist content, defamatory content or pornographic content involving minors, to promote fraudulent products or services.
  • Abuse others users: To harass, threaten, defame, rip off, extort, intimidate, annoy, abuse, incite to racial intolerance or violent acts against other users and employees of Blockunity. To collect and use their information against them. You are not allowed to conduct malicious activities, such as denial of service attacks, hacking attempts, or any other activity intended to harm the platform or its users, to violate the privacy of others, including by publishing personal information without permission.
  • Intellectual Property: To engage in any transaction that violates privacy, copyright and proprietary rights including without limitation: to delete the copyright or other proprietary rights notice; to copy, transfer, print, sell, rent, distribute, compile/decompile or change our services, by using our code. You are not allowed to distribute content that infringes the intellectual property rights of others, such as trademarks, patents or copyrights.

TERM AND TERMINATION

These Terms of Use will continue to govern your use of our services until either party decides to terminate them. If you decide to terminate this agreement, you can do so at any time and for any reason by canceling your access to our services. However, if we terminate this agreement, it will usually be because of a breach of these Terms of Use by you, which may result in temporary suspension of your access or termination of this agreement altogether.

In the event of any disputes between you and us regarding these Terms of Use or our services, we will try to resolve them through good faith negotiations. We believe that it is in the best interests of both parties to resolve any disputes in a fair and amicable manner, and we will work diligently to achieve this. We understand that disputes may arise, and we are committed to finding a resolution that is satisfactory to all parties involved. If we cannot resolve the dispute through negotiations, the dispute will be submitted to the exclusive jurisdiction of the Portuguese courts, and it will be governed by Portuguese law. We believe that this is the most appropriate jurisdiction and law to apply, given that we are a Portuguese-based company.

It is important to note that even if this agreement is terminated, certain provisions will continue to apply, including your obligation to pay any fees or charges that you may have incurred while using our services. Additionally, if we terminate your account, we may delete any content or data associated with your account, and we may also block your access to our services.

Finally, please note that creating a new account with a fake name, or a third-party name, is strictly prohibited and can lead to legal action.

We take our obligations and responsibilities under these Terms of Use very seriously, and we will always strive to act fairly and transparently. We believe that this approach will ensure that both parties are able to benefit from our services in a safe and secure manner, and we look forward to working with you.

THIRD-PARTY

A "third-party" usually refers to an entity external to the agreement or contract between the user and the provider of the online platform or service. This third-party may be a natural or legal person, such as a company, organization or individual, who is not a party to the legal relationship between the user and the provider.

Blockunity may allow you to use services, tools from other websites (“Third-Party”). We are not responsible for any Third-Party content, the accuracy or legality of their services, all risks you take and any damages or losses. If you decide to leave our platform for another website, or use their services, this is your sole responsibility. If you use a Third-Party service, you should read and agree to their Terms of Uses and Privacy Policies. Our platform works with third parties to provide some of the services we offer. These third parties may include business partners, third-party service providers, advertisers, social networks and other third-party websites linked from our platform. In this section, we explain how third parties may access or use our users' data, what limitations of liability we have to these third parties, and how disputes with third parties will be resolved. Please read the following terms and conditions carefully to understand our relationship with these third parties and how it may affect your use of our platform.

We work with third parties to provide high quality services to our users, including centralized cryptocurrency exchanges such as Binance. We use Binance to help us provide wallet services for our users. We also work with CoinMarketCap and TradingView to provide the more relevant data and give the best experience for our users.

AVAILABILITY AND ACCURACY

Our objective is to provide you the best services, although, we inform you that our platform can have some interruptions because of some internal or technical issues, or in a force majeure event. Cases of force majeure may include, but are not limited to : Natural disasters, such as earthquakes, hurricanes, floods, volcanic eruptions, etc. Acts of war, hostility, terrorism, sabotage, insurrection, rebellion or blockade. Network, server, computer system or hardware failures, which may result from a computer attack, power failure, fire. Decisions by government authorities, such as regulations, laws, orders, etc.

With that objective, we aim to provide you with as accurate information as possible, although our platform may not be exactly accurate, because of technical issues or adjustments we need to make. In that case, this information can change and be updated from time to time without notice. You have the data and all decisions you take after consulting this information are your sole responsibility.

  • Loss or damage coming from in an event of failure.
  • Cyberattack, malfunction or hack. Any errors, bugs, viruses, or other harmful components that may be transmitted to or through the platform by any third party.
  • Loss coming from Blockunity strategies.
  • Illegal use of our services.
  • Technical issues related to blockchain technologies.
  • Any direct, indirect, incidental, special, or consequential damages arising out of or in any way connected with the use or inability to use the platform, even if we have been advised of the possibility of such damages.
  • Any inaccuracies or omissions in any content on the platform.
  • Force majeure. Any failure or delay in the performance of the platform due to circumstances beyond our control, including but not limited to acts of God, war, terrorism, civil unrest, strikes, power failures, or equipment malfunctions.

INTELLECTUAL PROPERTY

This Site, its tree structure, is protected by copyright, European intellectual property and the Portuguese Intellectual Property Code (Código da Propriedade Intelectual).. European intellectual property law is primarily governed by Directive 2004/48/EC of the European Parliament and of the Council of 29 April 2004 on the enforcement of intellectual property rights. The Blockunity brand and its associated logos are declared to the INPI, protected and property of HYVI LDA. Any total or partial reproduction is strictly prohibited.

All strategies builded by users on Blockunity are our property, they can be exploited and transferred with no charge, for advertising and commercial purposes.
